So that we can act on your notice without a round trip, include the elements the Digital Millennium Copyright Act calls for:
We acknowledge notices within five business days. Where a notice is complete and the claim is not obviously mistaken, we remove or disable access to the material first and discuss it afterward. We would rather take down a paragraph we were entitled to keep than leave up one we were not.
We will tell you what we removed. Where the material was submitted by someone else, we notify them and pass on your notice.
If material of yours was removed and you believe that was a mistake or a misidentification, send a counter-notice to the same address. Include the material and where it appeared, a statement under penalty of perjury that you have a good-faith belief it was removed in error, your name, address, telephone number, your consent to the jurisdiction of the federal court for your district (or, if you are outside the United States, the District of New Mexico), and your signature. We may restore the material after ten business days unless the original complainant tells us they have filed suit.
Both notices and counter-notices carry legal weight. A knowing material misrepresentation in either one creates liability for damages under 17 U.S.C. § 512(f).
